CB Theater Experience ("CMX," "we," "us," or "our"), a subsidiary of Cinemex Holdings USA, Inc., acts as the Data Controller for your personal information. This Policy describes our practices regarding the collection, use, and disclosure of your personal information when you:
- Visit our website located at cmxcinemas.com (the "Site").
- Use the CMX Mobile Applications (the "Apps").
- Visit and interact with us at our physical cinema locations (the "Theatres").
- Participate in the "CMX Rewards and Loyalty Program" (the "Services").

In accordance with applicable data protection laws, including the GDPR where applicable, we rely on the following legal grounds to process your information:
- Performance of a Contract: Processing is necessary to provide movie tickets, manage your CMX Rewards account, and fulfill purchases.
- Consent: When you explicitly opt-in to receive marketing newsletters or personalized promotional offers.
- Legitimate Interests: To analyze theater performance, prevent fraudulent activity, and utilize strategic behavioral analysis to improve our service offerings.
- Legal Obligation: To comply with tax, security, or regulatory reporting requirements.

Global Infrastructure: Your data is processed in jurisdictions where our specialized service providers (such as Showtime Analytics and CinemaPlus) maintain facilities.
Data Security and Retention
We implement appropriate technical and organizational measures, including encryption and access controls, to protect your personal information against unauthorized access or loss.
We retain your information only for as long as necessary to fulfill the purposes outlined in this Policy. Points and vouchers expire after 12 consecutive months of account inactivity, after which associated loyalty records may be archived. CCTV footage is typically retained for a limited period unless required for legal or security investigations.
Your Rights and Choices
Depending on your location, you may have the following rights:
- Access & Portability: Request a copy of the personal information we hold in a machine-readable format.
- Rectification: Update or correct your profile information via the CMX App.
- Erasure: Request deletion of your data, subject to legal and contractual retention requirements.
- Restriction & Objection: You have the right to object to the processing of your personal information for specified purposes. Please note that in certain instances, exercising this right may result in our inability to provide certain services or features to you. For example, the objection to the processing of data necessary for the CMX Rewards program or other specialized services may result in the inability to access those specific benefits, accrue points, or redeem vouchers.
- Loyalty Retention: Points and vouchers expire after 12 consecutive months of account inactivity, after which associated loyalty records may be archived.
State-Specific Privacy Rights
If you are a resident of Virginia or other states with comprehensive privacy laws (such as those where we operate), you may have additional rights regarding your personal data. This includes the right to opt-out of targeted advertising and the right to appeal a decision regarding a privacy request. The CMX Rewards Program may be considered a "financial incentive" or "bona fide loyalty program" under these laws; participation is optional and you may withdraw at any time.
Governing Law and Disputes
You agree that any dispute, claim, or controversy arising out of or relating in any way to this Policy, your use of the Site or Apps, your participation in the Services, or your visit and interaction with our physical Theatres (including any related disputes involving our parent companies, subsidiaries, or affiliates), whether based in contract, tort, statute (including the VPPA), fraud, misrepresentation, or any other legal theory, shall be resolved exclusively by individual binding arbitration. This includes claims arising from past, present, or future events.
YOU HEREBY WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHTS TO SUE IN COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR A JURY. YOU AGREE THAT YOU MAY BRING CLAIMS AGAINST THE CMX CINEMAS ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, REPRESENTATIVE, OR CONSOLIDATED PROCEEDING. The arbitrator shall have no authority to entertain any claim on a class-wide basis, nor to consolidate more than one person's claims, regardless of the similarity of the dispute or the legal issues involved.
By using the Services, you signify this agreement for yourself and for all persons (including minors) for whom you are purchasing or otherwise securing benefits. You represent that you have all necessary rights and consents to agree to these Terms on behalf of your party.
Before commencing arbitration, you agree to send a written notice of dispute to CMX and attempt to resolve the matter through informal negotiation for a period of sixty (60) days. Only after this period may either party commence a binding arbitration administered by the American Arbitration Association (AAA) in Miami, Florida.
This arbitration agreement shall survive the termination of your relationship with CMX Cinemas and shall be governed by the Federal Arbitration Act.
